Abstract

This study examines the violation of the absolute competence of the Consumer Dispute Resolution Agency (BPSK) in adjudicating a consumer financing dispute, based on Medan District Court Decision Number 1196/Pdt.Sus-BPSK/2025/PN Mdn. The issues addressed concern the BPSK's breach of absolute competence when hearing a dispute arising from a financing agreement, as well as the judge's legal reasoning for setting aside the BPSK's decision. The study aims to legally identify the nature of the BPSK's absolute competence violation and the judge's legal considerations in the aforementioned Medan District Court decision. It employs a normative-juridical research method utilizing statutory, case, and conceptual approaches. Data collection was conducted through literature review, followed by qualitative data analysis. The findings indicate that the BPSK exceeded its absolute competence by adjudicating a dispute regarding breach of contract—a matter falling within the civil law domain—prompting the judge to set aside the BPSK's decision to ensure legal certainty, justice, and the orderly exercise of authority in dispute resolution.
