Abstract
Human trafficking is an extraordinary crime, particularly when children fall victim to commercial sexual exploitation, which remains an extraordinary issue in Indonesia. Although the Law of the Republic of Indonesia Number 21 Year 2007 on the Eradication of the Criminal Act of Trafficking in Persons regulates the elements of exploitation and restitution rights for child victims, its implementation in criminal justice practices still reveals a substantial gap. This study aims to analyze the application of exploitation elements against child victims of commercial sex work and evaluate the fulfillment of restitution rights under the Eradication of Trafficking in Persons Law. Utilizing a normative legal research method with statutory, conceptual, and case approaches, this study examines primary legal materials comprising legislation and court decisions alongside secondary legal materials such as books, legal journals, and scholarly articles, analyzed qualitatively. The study reveals two main findings. First, the application of exploitation elements remains inconsistent due to differing judicial interpretations regarding the relevance of a child victim’s consent. Some judges still apply general legal logic prioritizing voluntariness, disregarding Article 26 of the law, which explicitly states that a child’s consent does not eliminate the perpetrator’s criminal liability. Second, the fulfillment of restitution rights remains inconsistent, depending heavily on the initiative of the Public Prosecutor and the involvement of the Witness and Victim Protection Agency (LPSK) rather than being systematically guaranteed. This lack of uniformity contravenes Articles 48, 49, and 50 of the Law on the Eradication of Criminal Acts of Trafficking in Persons, and disregards the proactive duty of prosecutors to inform and assist victims with restitution claims as stipulated in Article 18(1) of Supreme Court Regulation No. 1 of 2022. Both findings reflect that a child protection perspective has not yet been fully integrated as the primary foundation in law enforcement practices against human trafficking in Indonesia.
