Abstract

Regulations regarding the rights of BPJS patients are based on a strong and clear legal foundation. This is reflected in various national regulations, such as Article 28H paragraph (1) and Article 34 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, Law Number 36 of 2009 on Health, and Law Number 24 of 2011 on the Social Security Administering Body (BPJS). All of these regulations emphasize that every citizen has the right to proper, fair, and non-discriminatory healthcare services, including the right to choose a referral health facility. Through an interactive data analysis method, this research employs data collection techniques such as literature studies and interviews. This study explains that the regulation and fulfillment of BPJS patients' rights in choosing a referral hospital are supported by a strong legal foundation, which obliges the state to ensure access to fair and non-discriminatory healthcare services. However, its implementation in practice such as at RSUD Dungus still faces various administrative and technical obstacles, along with a lack of patient understanding regarding their rights and the applicable procedures. Therefore, although the regulations are in place, their fulfillment needs to be improved through a more transparent, educational, and rights-oriented system to truly realize social justice in the healthcare sector.
