Abstract
This study examines the "pathway to justice" analysis in the protection of Indonesian migrant workers in the fishing industry. The phenomenon of exploitation of Indonesian migrant workers, particularly crew members (ABK) in the fishing industry, is a complex and urgent issue. Cases of forced labor, violence, wage withholding, and human rights violations frequently occur, both on foreign-flagged and national vessels. This study analyzes national and international legal regulations governing the protection of migrant workers, identifies the obstacles faced in providing access to justice, and examines the concept and implementation of the pathway to justice as a form of legal and social protection for migrant workers in the fishing sector. This research is of a normative legal nature, employing a regulatory, conceptual, and case study approach. The research findings indicate that: 1) the implementation of national and international legal regulations in providing protection for migrant workers in the fishing sector is not yet optimal. 2) The main obstacles found in providing access to justice for the protection of migrant workers in Indonesia are weak law enforcement, lack of coordination between institutions, and low legal literacy among migrant workers. 3) The study of the pathway to justice in providing protection for migrant workers in the fishing industry is considered to be an alternative solution by emphasizing the accessibility of information, state involvement, and the active role of civil society in ensuring the protection of migrant workers rights.
