Abstract
An Nafin, 2024. Juridical Review of Legal Policies on Child Protection for Victims of Sexual Abuse in the School Environment Based on Law Number 35 of 2014 concerning Child Protection. Thesis. Law Study Program, FH, University of PGRI Madiun. Supervisor (I) Dr. Sulistya Eviningrum, S.H., M.H. (II) Bintang Ulya Kharisma, S.H., M.Kn. Sexual abuse has a physical and psychological impact on children. The Indonesian government has stipulated Law Number 35 of 2014 concerning Child Protection, but there are still many schools that have not implemented a policy to protect children from sexual abuse cases. The purpose of this research is to find out the factors that cause cases of sexual abuse of children in the school environment and legal protection of children in cases of sexual abuse in the school environment. The method used in this study is normative juridical, the collection of legal materials through library research. The data analysis techniques used are the syllogism and interpretation methods. Based on the results of the research, first, acts of sexual abuse against children still often occur in the educational environment, one of which is schools. Related to this, there are several factors that cause acts of abuse in children in the school environment, including: lack of sexuality education; abuse of power; school environmental factors; low ethics and morals; religious education; and culture. The results of the second study, school is a place of learning for children in pursuing knowledge but in reality it is often used as a place for sexual crimes, in this case educational institutions should provide policies for victims of sexual abuse in children. In addition, strict action needs to be taken when sexual harassment occurs in schools. As stipulated in Article 81 and Article 82 of Law Number 35 of 2014 concerning Child Protection. Meanwhile, sexual harassment caused by peers with treatment better known as bullying can be filed in the district court in accordance with Law Number 11 of 2012 concerning the Juvenile Criminal Justice System.
