(II) Dr. Siska Diana Sari, S.H., M.H. This study aims to analyze the judge's considerations in the Probolinggo Religious Court Decision Number 42/Pdt.G/2024/PA.Prob regarding the transfer of child custody (hadhanah) to the father after a divorce. This study uses a normative legal method with a statutory approach and a case approach. The results of the study indicate that the revocation of custody rights should be based on gross negligence or the inability of the custody holder to guarantee the best interests of the child. However, the decision did not find sufficient evidence of negligence on the part of the father, so the judge's considerations are deemed not fully in accordance with applicable legal provisions and the principle of the best interests of the child.
