Abstract
The widespread unlicensed compounding and distribution of firecrackers in Indonesia poses a serious threat to public safety and social order, exacerbated by the ease of obtaining raw materials through e-commerce and the free availability of compounding tutorials on digital media. This study aims to examine: (1) the regulatory framework governing firecracker explosive compounding and distribution in Indonesia; and (2) the criminal liability of perpetrators under Indonesian criminal law. This study employs a normative juridical method with a descriptive-analytical approach, applying both a statutory approach and a case approach using Ponorogo District Court Judgment No. 64/Pid.Sus/2024/PN Png as the primary object of analysis. The findings indicate that Indonesia's regulatory framework is structured in multiple layers, centered on Emergency Law No. 12 of 1951, reinforced by the Criminal Code, Law No. 1 of 2023, National Police Regulation No. 2 of 2008, and National Police Regulation No. 17 of 2017. Two regulatory gaps remain unaddressed: the distribution of precursor materials through e-commerce and sales via social media channels outside any authority's supervisory jurisdiction. Criminal liability is grounded in the principle of geen straf zonder schuld, requiring the integral fulfillment of actus reus and mens rea. The court sentenced the 19-year-old defendant to 6 months' imprisonment, well below the statutory maximum, considering the defendant's age, simple economic motive, cooperative conduct, and the absence of actual victims.
