Abstract

This study aims to analyze the causes of disparities in granting sentence reductions to justice collaborators in Indonesia from the perspective of Gustav Radbruch. This research employs a normative legal method with statutory, conceptual, case, and comparative law approaches. The findings indicate that the regulation of justice collaborators in Indonesia does not yet provide clear parameters regarding sentence reductions, resulting in disparities in judicial decisions. From Gustav Radbruch’s perspective, this condition has not fully reflected the values of justice, legal expediency, and legal certainty. A comparison with the Collaboratore della Giustizia model in Italy demonstrates the importance of clearer regulations concerning the requirements, protection, and rewards granted to justice collaborators. Therefore, regulatory reform is necessary to achieve greater legal certainty and justice.
