Abstract
Sextortion is a digital-based sexual crime that uses the threat of disseminating intimate content as a tool of extortion or control over victims. This crime has become increasingly prevalent in Indonesia along with the rapid development of information and communication technology. However, its regulation under Indonesian positive law has not been explicit and comprehensive. This study aims to examine the criminal law policy on the crime of sextortion under Law Number 12 of 2022 concerning Sexual Violence Crimes (UU TPKS), as well as to formulate an ideal criminal law policy for addresing sextortion in the future. This study employs a normative juridical, prescriptive research metode with three approach. The legal materials used consist of primaary, secondary, and tertiary legal material. Analyzed qualitatively. The result show that althought UU TPKS does not explicitly mention the term “sextortion”, the elements of the crime of sextortion can be found in Article 4 paragraph (1) letter 1, Article 14, and Article 15 of UU TPKS. Nevertheless, inconsistencies in its application by law enforcement officers still occur, as reflected in Padang District Court Decision Number 964/Pid.Sus/2023/PN.Pdg, which applied the Electronic Information and Transactions Law (UU ITE) instead of UU TPKS as the basis for prosecution. An ideal criminal law policy (de lege ferenda) requires aan explicit reform of the sextortion offense within UU TPKS, accompanied by firmer and more comprehensive criminal sanctions, as a manifestation if Indonesia’s commitment to achieving Suistanable Development Goals (SDGs) Goal 5 and Goal 16 concerning peaace, justice, aand strong institutions.
