Jumangin. 2026. Elimination of Forgiveness for Children of Perpetrators of the Crime of Theft by Repetition (Case Study of the Decision of PN Labuan Bajo Number: 1/Pid.Sus-Anak/2026/PN Lbj). Thesis. Law Study Program, FH, PGRI UNIVERSITY MADIUN. Supervisor (I) Dr. Sulistya Eviningrum, S.H., M.H. (II) Nizam Zakka Arrizal, S.H., M.Kn. This research was motivated by the problem of the denial of forgiveness for children who committed the crime of theft by repetition in the Labuan Bajo District Court Decision Number: 1/Pid.Sus-Anak/2026/PN Lbj. Despite the attitude of forgiveness on the part of the victim, the judge still handed down the verdict by considering the repetition of the crime as a mitigating factor. This study aims to analyze the basis of judges' legal considerations in eliminating forgiveness for children who commit the crime of theft by repetition. The research method used is normative juridical with a statutory approach and a case approach through the study of legal regulations and related court decisions. The literature review in this study uses the concepts of the juvenile criminal justice system, restorative justice, forgiveness, and repetition of criminal acts. The results of the study show that the judge's consideration in imposing a verdict is based on the interests of law enforcement, child development aspects, and the recurrence of criminal acts which shows the need for further legal action. The conclusion of this study is that the elimination of forgiveness for children who commit theft with repetition can be applied juridically as long as it still pays attention to the principles of child protection, the best interests of the child, and the balance between legal certainty, justice, and utility.
