Abstract

The development of AI, especially AI voice cloning, has been used as a means of digital fraud through the WhatsApp application which raises issues regarding the criminal liability of perpetrators and the recovery of victims. This study aims to analyze the criminal responsibility of perpetrators and legal recovery against victims of digital fraud based on AI voice cloning. This study is a normative legal research with legislation and conceptual approach. The results showed that first, the perpetrators can still be held criminally responsible under the Criminal Code and the law on information and electronic transactions because AI voice cloning only serves as a means of criminal acts. Second, recovery of victims can be done through restitution, return of evidence, tort lawsuit, settlement based on the agreement of the parties, and banking mechanisms.
