Abstract
This study aims to analyze the factors underlying a wife's consent in polygamy permit applications and to examine the fulfillment of a wife's normative rights in polygamy permit rulings issued by the Madiun Regency Religious Court in 2025. Polygamy is a form of marriage permitted under Indonesian law only within specific limits and subject to certain conditions, one of which is the wife's consent. In practice, such consent does not always stem from free will but may be influenced by social, economic, cultural, or psychological factors, necessitating an analysis from a juridical perspective. This research employs a normative legal research method utilizing statutory, case, and conceptual approaches. Data sources consist of primary, secondary, and tertiary legal materials analyzed qualitatively through literature reviews and an examination of polygamy permit rulings issued by the Madiun Regency Religious Court in 2025. The findings indicate that the factors underlying a wife's consent include economic, religious, socio-cultural, and psychological factors, as well as considerations regarding the preservation of household integrity. From a juridical perspective, the wife's consent holds a crucial position as both a substantive and administrative requirement for polygamy permit applications, as stipulated in Law Number 1 of 1974 concerning Marriage, Government Regulation Number 9 of 1975, and the Compilation of Islamic Law. The study also finds that the fulfillment of a wife's normative rights in polygamy permit rulings is generally taken into account by judges through the assessment of the husband's ability to provide financial support, ensure fairness, and protect the rights of the wife and children.
