Abstract

Climate change is a real threat, especially to human survival and the environment. One of the main factors is greenhouse gas emissions resulting from human activities. Consequently, climate justice has become a critical issue, as vulnerable groups are disproportionately affected by climate change. These groups contribute the least to emissions but suffer the most severe impacts. This situation is known as the “triple injustice.” This study is a normative or doctrinal legal study, employing conceptual, comparative, case-based, and statutory approaches. The data sources used include primary, secondary, and tertiary legal materials. This study compares case studies from two countries: Indonesia, a developing country, and Denmark, a developed country. Regarding this comparison, the study yields two main findings. First, climate justice in environmental law is analyzed using three theoretical frameworks: environmental law theory, climate justice theory, and human rights theory. These three theories address the recognition of the rights of vulnerable groups, whether protected under international or national law. Second, a comparison between Indonesia and Denmark reveals fundamental similarities and differences. One example of a similarity is the ratification and implementation of international regulations, namely the Paris Agreement. One example of a fundamental difference is that Indonesia does not yet have specific climate regulations, whereas Denmark already has specific regulations with emission reduction targets. This study also offers recommendations, one of which is the drafting and enactment of specific climate regulations.
