Abstract

This study examines the provision of legal certainty for children born from unregistered marriages through the determination of the child's origin based on Religious Court Decree Number 523/Pdt.P/2024/PA.Badg. The problem in this study is related to the judge's legal considerations regarding the status of children from unregistered marriages when the biological father has died and the legal certainty obtained by the child after the determination of the child's origin. The purpose of this study is to find out the judge's legal considerations and to find out the legal certainty for children born from unregistered marriages. The topics discussed are (1) the judge's legal considerations in determining the status of children from unregistered marriages as stipulated in Religious Court Decree Number 523/Pdt.P/2024/PA.Badg and (2) aspects of legal certainty for children from unregistered marriages as stipulated in Bandung Religious Decree Number 523/Pdt.P/2024/PA.Badg. The type of normative juridical research uses a statutory approach, a case approach, and a conceptual approach. Data collection through literature studies with qualitative data analysis techniques. The research results show that the judge's considerations were based on evidence, witness statements, and applicable legal provisions so that the application was granted.
