Abstract

This research is motivated by the continuing prevalence of cases of verbal, social and psychological bullying that befell children with special needs (ABK) in inclusive school environments. Even though child protection regulations are available, there is a gap between the applicable legal provisions (das sollen) and the real conditions in the field (das sein), where legal protection for crew members who are victims of bullying at SMP Negeri 10 Madiun City is considered not to be running optimally. The aim of this research is to analyze the effectiveness of the implementation of legal protection for children with special needs who are victims of bullying at SMP Negeri 10 Madiun City and identify the obstacles that influence the effectiveness of this protection. This research method uses an empirical juridical analysis approach with a case study method. Data was collected through observation and analysis of preventive and repressive efforts carried out by the school in handling cases of bullying against ABK by referring to Law Number 35 of 2014 concerning Child Protection and Law Number 8 of 2016 concerning Persons with Disabilities. The results of the research show that: firstly, SMP Negeri 10 Madiun City has implemented preventive (through socialization, character education, and supervision) and repressive (through mediation, counseling, and sanctions) legal protection efforts. However, this implementation has not been completely effective. The two internal obstacles found included limited evidence, a lack of competent Special Assistant Teachers (GPK), and communication barriers for victims. External obstacles include the defensive attitude of the perpetrator's parents and the absence of a specific Standard Operating Procedure (SOP) for handling bullying for ABK. This research concludes that the implementation of legal protection for crew members who are victims of bullying at SMP Negeri 10 Madiun City is already underway but has not yet reached the expected level of effectiveness. To increase effectiveness, it is necessary to prepare SOPs for special handling, provide special assistant teachers by the Education Department, and strengthen synergy between schools and parents.
