Abstract
This study examines the fulfillment of occupational safety and health rights for gig economy couriers at PT Shopee Express Indonesia. The research employs empirical legal research (socio-legal research) with a socio-juridical approach. This study aims to analyze the fulfillment of occupational safety and health rights and the forms of liability of PT Shopee Express Indonesia under civil and labor law. The theoretical foundations include Gustav Radbruch's Legal Certainty Theory, Satjipto Rahardjo's Legal Protection Theory, John Rawls' Theory of Justice, Liability Theory, and Employment Relationship Theory. In this context, couriers who hold the status of business partners should still receive occupational safety and health protection, whether through BPJS Employment participation, provision of safety equipment, compensation provision, or the availability of K3 documents and guidelines. The findings indicate that, legally, the fulfillment of K3 rights for couriers has a strong legal basis in various laws and regulations such as Law No. 1 of 1970, Law No. 13 of 2003, and Government Regulation No. 50 of 2012. However, in practice, the fulfillment of K3 rights remains suboptimal due to various obstacles. The problems identified include very low BPJS Employment participation, unavailability of safety equipment from the company, minimal K3 socialization, and the absence of clear accident reporting mechanisms. This study concludes that the success of fulfilling K3 rights for couriers does not solely depend on the company's legal obligations, but also requires a holistic approach through strengthening regulations, government oversight, increasing corporate responsibility, and legal education and awareness for couriers to achieve effective, fair, and sustainable protection.
