This study is motivated by the discrepancy between the principle of checks and balances in a state governed by the rule of law and the practice of local government administration. Although Law No. 23 of 2014 on Local Government has regulated the division of authority between regional heads and regional legislative councils (DPRD), its implementation has not yet fully reflected an effective oversight mechanism. This study aims to analyze the regulation of regional heads’ authority in strategic decision-making as well as the legal implications of regional heads’ dominance on the implementation of the principle of checks and balances. This study employs a normative legal method using a statutory, conceptual, and case-based approach. The results of the study indicate that the dominance of regional heads is reflected in unilateral decision-making, policies that bypass formal mechanisms, and the abuse of authority. These conditions result in violations of the principles of legality, accountability, and legal certainty, thereby weakening the oversight function of the Regional People’s Representative Council (DPRD), the quality of local democracy, and good governance.
