Abstract
Online transactions for skincare products have expanded rapidly alongside technological advancements; however, this convenience has also created opportunities for widespread fraud such as exaggerated product claims, product identity falsification, the use of misleading information, and the distribution of products lacking BPOM (Indonesian FDA) marketing authorization. This situation has resulted in legal gaps and normative inconsistencies regarding the handling of evolving digital fraud schemes, necessitating a doctrinal study to establish an appropriate legal framework. This research aims to analyze legal regulations concerning fraud in online transactions, examine the criminal liability of perpetrators of skincare product fraud on digital platforms, and analyze the forms of legal protection available to consumers. The study employs a normative-juridical method with a descriptive nature, utilizing statutory, conceptual, and case approaches, while analyzing primary, secondary, and tertiary legal materials qualitatively. The findings indicate that legal regulations regarding online transaction fraud are addressed complementarily through the Criminal Code (KUHP), Law Number 1 of 2023 concerning the National Criminal Code (Article 492), the Consumer Protection Law, and the ITE Law (Electronic Information and Transactions Law). Perpetrators including parties who promote misleading claims—may be held criminally liable if the element of culpability is met and there are no grounds for justification or excuse. Legal protection for consumers is implemented through two forms: preventive protection (BPOM supervision, education, and platform oversight) and repressive protection (reporting, claims for damages, dispute resolution, and legal sanctions). These measures demonstrate that Indonesian positive law possesses adequate mechanisms to protect consumers from digital fraud practices.
