Abstract

ABSTRAK Surat pernyataan ahli waris merupakan surat yang menerangkan siapa saja ahli waris dari seseorang yang telah meninggal dan siapa saja yang berhak menjadi ahli waris. Penelitian ini mengkaji terkait aspek hukum dalam pengurusan Surat Pernyataan Ahli Waris di Kecamatan Manguharjo. Penelitian ini menggunakan metode penelitian yuridis empiris, penelitian ini menggabungkan pendekatan perundang-undangan dan pendekatan kasus. Data diperoleh melalui wawancara dan studi dokumen. Tujuan penelitian adalah untukmenganalisis prosedur, permasalahan, dan solusi dalam proses pengurusan surat pernyataan ahli waris. Hasil penelitian menunjukkan bahwa proses pengurusan Surat Pernyataan Ahli Waris di Kecamatan Manguharjo telah mengikuti prosedur hukum yang berlaku, dimulai dari tingkat kelurahan hingga kecamatan. Berdasarkan hasil penelitian ditemukan beberapa permasalahan utama yaitu ketidaklengkapan dokumen, intervensi dari pihak ahli waris, kurangnya pemahaman masyarakat tentang hukum waris, dan ketidak telitian petugas dalam mengelola dokumen. Penelitian ini menyimpulkan bahwa efektivitas pengurusan Surat Pernyataan Ahli Waris dapat ditingkatkan melalui perbaikan sistem administrasi dan edukasi hukum kepada masyarakat. Berdasarkan teori sistem hukum dan teori hukum negara, penelitian ini mengusulkan beberapa saran, termasuk peningkatan sosialisasi hukum waris kepada masyarakat, peningkatan ketelitian petugas, dan penerapan sistem verifikasi dokumen yang lebih ketat. ABSTRACT This research examines the legal aspects of processing a Statement of Heirs in Manguharjo District. A statement of heirs is a letter that explains who the heirs of a person who has died are and who is entitled to be an heir. Using empirical juridical research methods, this research combines a statutory approach and a case approach. Data was obtained through interviews and document studies. The purpose of the research is to analyze the procedures, problems, and solutions in the process of processing the heir statement letter. The results showed that the process of processing the Statement of Heirs in Manguharjo Subdistrict had followed the applicable legal procedures, starting from the village level to the subdistrict. Based on the results of the research, several main problems were found, namely incomplete documents, intervention from the heirs, lack of public understanding of inheritance law, and inaccuracy of officers in managing documents. This study concludes that the effectiveness of processing the Statement of Heirs can be improved through improving the administrative system and legal education to the community. Based on legal system theory and state law theory, this study proposes several suggestions, including increased socialization of inheritance law to the community, increased officer thoroughness, and the implementation of a stricter document verification system.
