Abstract

Hak atas pendidikan merupakan hak asasi manusia yang esensial dan mencakup berbagai aspek kehidupan, termasuk ekonomi, sosial, budaya, serta sipil dan politik. Pemerintah Indonesia memiliki tanggung jawab untuk menjamin hak ini sesuai dengan standar hak asasi manusia internasional dan UUD 1945, yang mencakup Pasal 28C dan Pasal 31 Ayat (2) yang menegaskan kewajiban negara dalam menyediakan pendidikan dasar secara gratis dan alokasi 20 persen dari APBN untuk pendidikan. Meskipun berbagai jaminan telah dibuat, kenyataan di lapangan menunjukkan tantangan besar seperti angka putus sekolah yang tinggi selama pandemi Covid-19, terutama di Kabupaten Madiun.Penelitian ini bertujuan untuk mengetahui bagaimana pemenuhan hak konstitusional untuk mendapatkan pendidikan berdasarkan gender di Madiun. Jenis penelitian yang digunakan oleh peneliti adalah jenis penlitian kualitatif dengan pendekatan fenomenologi dimana hasil data berdasarkan pada pendapat dan pengalaman narasumber yang bersangkutan. Pengumpulan data dalam penelitian ini menggunakan metode wawancara, dan juga dokumentasi. Dalam penelitian ini, peneliti menggunakan triangulasi metode untuk mengetahui keabsahan data. Proses analisis data untuk penelitian ini menggunakan model interaktif yaitu dengan reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menemukan bahwa; pemenuhan hak konstitusional untuk mendapatkan Pendidikan berdasarkan gender di Madiun masih belum cukup merata dikarenakan; Faktor penyebab terjadinya ketimpangan gender dalam dunia pendidikan ada 4 faktor yaitu; keluarga, social budaya (lingkungan), ekonomi, dan kurangnya kesadaran Pemerintah The right to education is an essential human right and covers various aspects of life, including economic, social, cultural, as well as civil and political. The Indonesian government has a responsibility to guarantee this right in accordance with international human rights standards and the 1945 Constitution, which includes Article 28C and Article 31 Paragraph (2) which emphasizes the state's obligation to provide free basic education and an allocation of 20 percent of the APBN for education. Although various guarantees have been made, the reality on the ground shows major challenges such as high dropout rates during the Covid�19 pandemic, especially in Madiun Regency.This study aims to determine how the fulfillment of constitutional rights to obtain gender-based education in Madiun. The type of research used by the researcher is a qualitative research type with a phenomenological approach where the data results are based on the opinions and experiences of the relevant informants. Data collection in this study used interview methods, and also documentation. In this study, researchers used triangulation methods to determine the validity of the data. The data analysis process for this study used an interactive model, namely data reduction, data presentation, and drawing conclusions. The results of the study found that; the fulfillment of constitutional rights to obtain gender-based education in Madiun is still not evenly distributed because; There are 4 factors causing gender inequality in the world of education, namely; family, socio-cultural (environment), economy, and lack of government awareness..
