Abstract

The increasing involvement of children in criminal offenses requires a juvenile justice system that emphasizes rehabilitation and the best interests of the child rather than punishment. This study examines the juridical appropriateness of imposing an educational measure through an Islamic boarding school (pesantren) on a juvenile convicted of aggravated motor vehicle theft in Decision Number 2/Pid.Sus-Anak/2026/PN Madiun. The research analyzes: (1) the consistency of the court's ratio decidendi with the ultimum remedium principle under Law Number 11 of 2012 on the Juvenile Criminal Justice System, and (2) the fulfillment of legal certainty and the protection of children's rights through the imposed sanction. This normative legal research employs statutory, case, and conceptual approaches using primary, secondary, and tertiary legal materials. The findings reveal that the court's reasoning is consistent with the ultimum remedium principle. Although the juvenile was found guilty under Article 477 paragraph (1) letter (e) of Law Number 1 of 2023 concerning the Indonesian Criminal Code, the court imposed an educational measure at Pondok Pesantren Riyaadlul Jannah instead of imprisonment. The decision was based on the child's personal circumstances, the Social Inquiry Report (Litmas), and the best interests of the child principle. The sanction is supported by Article 82 of the Juvenile Criminal Justice System Law and Law Number 18 of 2019 on Islamic Boarding Schools, ensuring the child's rights to education, rehabilitation, and social reintegration. The decision reflects a restorative and humanistic approach to juvenile criminal justice.
