Abstract
Globalization and digitalization have opened markets, boosted growth, and eased technology transfer, but also bring challenges in regulation, data protection, and access. The SDGs stress fair and sustainable trade as a driver of development. In Indonesia, trade law is based on the 1945 Constitution, KUHD, KUHPerdata, and laws such as Law No. 7 of 2014 on Trade and Law No. 20 of 2008 on MSMEs, aimed at strengthening local products and protecting consumers. In Madiun City, especially Manguharjo District, MSMEs are the backbone of the local economy with government support. Yet, limited halal certification and weak protection against unfair competition remain obstacles. This shows the need to improve trade regulations to ensure legal certainty, business sustainability, and stronger MSME contributions in the era of globalization. The method used is juridical-empirical research of a descriptive nature with a sociology of law approach, using primary and secondary data collected through interviews, observation, and document study, analyzed using the Miles and Huberman qualitative technique. Results show that commercial law arrangements in Indonesia originate from the Commercial Code (KUHD) as lex specialis and the Civil Code (KUHPerdata) as lex generalis, reinforced by sectoral laws such as Law Number 7 of 2014 on Trade, Law Number 20 of 2008 on UMKM, and the Job Creation Law through a risk-based licensing system (NIB/OSS). Implementation among UMKM in Manguharjo is not yet fully optimal; most actors have obtained a Business Identification Number (NIB), yet halal certification, trademark registration, and written contracts remain very limited. The study identifies five main constraints: low legal literacy, limited access to sectoral licensing, a digital literacy gap, limited capital and legal resources, and rapidly changing regulations without adequate dissemination. It is recommended that the Madiun City Government, the Subdistrict, and related agencies strengthen periodic legal dissemination and revive free licensing assistance for UMKM.
