Abstract
ABSTRACT Aprilia Maharani. 2026. Analysis of Juvenile Criminal Liability as Perpetrators of Sexual Violence Resulting in Death (Study of the Decision of the Palembang District Court Number 50/Pid.Sus.Anak/2024/PN Plg). Sexual violence committed by a child that results in the victim's death presents a challenging legal issue, as it requires balancing two equally important interests: safeguarding the rights of the child offender and ensuring justice for the victim. In resolving such cases, judges must carefully evaluate both legal and non-legal considerations before imposing a sentence, particularly when determining the child's criminal liability. Accordingly, this study examines the judicial considerations underlying the imposition of criminal sanctions on child offenders in cases of sexual violence causing death, as well as the legal basis for holding them criminally accountable. This research employs a normative legal method using both the statutory approach and the case approach. The findings indicate that judges base their decisions on juridical, philosophical, and sociological considerations. In reaching a verdict, judges assess the evidence presented during the trial, the facts established in court, the offender's age and personal circumstances, and the severity of the consequences suffered by the victim. These considerations demonstrate an effort to balance the child's legal protection with the victim's right to justice. Furthermore, the study concludes that a child may be held criminally liable when all elements of the offense have been proven, the child possesses the capacity for criminal responsibility, fault has been established, and no legal grounds for justification or excuse exist. Such accountability is consistent with the principles of the Juvenile Criminal Justice System, which emphasize rehabilitation, guidance, and the protection of the child's best interests.
