Abstract

This study aims to analyze the comparison between the Board of Peace Charter and Indonesia's "independent and active" foreign policy principle, viewed through the perspective of the 1945 Constitution of the Republic of Indonesia. The research is motivated by the emergence of the Board of Peace as an organizing body authorized to address peace efforts and the crisis in Gaza arising from the Israel-Palestine conflict. The researcher identifies significant implications—particularly regarding the relevance of the Board of Peace's existence to Indonesia's foreign policy principles and its constitution—given that Indonesia has confirmed its membership in the body. This is a normative or doctrinal legal study characterized by a normative-descriptive approach. The study employs statutory, conceptual, and comparative approaches, all grounded in secondary data sources. These secondary data comprise three categories of legal materials: primary, secondary, and tertiary. Data were collected through a literature review and analyzed using legal interpretation methodologies. The analysis yields a systematic understanding of the comparison and normative relevance between the subjects of study: the Board of Peace Charter and the "independent and active" foreign policy principle. The comparative analysis involves contrasting the two subjects and examining their respective weaknesses and shortcomings. Meanwhile, the analysis of relevance explores the relationship between the Board of Peace Charter and the 1945 Constitution, as well as the implications of Indonesia's participation in the Board of Peace under that constitutional framework.
