Abstract
The involvement of children as drug couriers raises legal issues because children are not only positioned as perpetrators of criminal acts but also as victims of exploitation by drug trafficking networks. The application of criminal liability focused on punishment often neglects the protection of children’s rights. This study aims to analyze the legal status of children as drug couriers from the perspectives of criminal liability and child protection, as well as to examine the application of the concepts of “victimless crime” and child exploitation as grounds for exoneration or mitigation of punishment. The research method employed is normative legal research using a statutory approach, a conceptual approach, and a case-based approach. The types and sources of research data consist of primary, secondary, and tertiary legal materials collected through a literature review, which were then analyzed normatively using legal reasoning and interpretation of applicable laws and regulations. The results of the study indicate that: First; children used as drug couriers cannot be viewed solely as perpetrators of criminal acts but must also be regarded as victims of exploitation who require legal protection. Second; criminal liability for children must take into account aspects of exploitation and the best interests of the child, while prioritizing a rehabilitative approach and restorative justice to ensure comprehensive legal protection.
