Abstract
The development of Artificial Intelligence (AI) technology in the digital era has given rise to innovation opportunities as well as the potential for new cybercrimes in Indonesia, such as deepfakes, financial fraud, and personal data exploitation. This study aims to analyze the legal regulations on AI in Indonesia legally, as well as review the effectiveness of preventive measures against criminal acts in the field of Information and Electronic Transactions (ITE). This study uses a normative legal method with a statutory and comparative legal approach. Primary and secondary legal data used include Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions, Law Number 27 of 2022 concerning Personal Data Protection, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, and regulations from other countries such as the European Union, the United States, China, Singapore, and Japan. The results of the study indicate that: 1) Indonesia does not yet have many specific regulations governing the use and supervision of AI. A comparative legal study highlights that the risk-based approach implemented in the EU AI Act is more effective as a relevant preventive regulatory model adopted in Indonesia. 2) Preventive efforts in Indonesia are still weak in effectiveness, with a limited legal framework regarding the attribution of criminal liability in the AI ecosystem.
