Abstract

The rising phenomenon of unregistered (siri) mixed marriages between Indonesian citizens (WNI) and foreign nationals (WNA) has raised serious legal concerns, particularly regarding the status and protection of children born from such unions. These children often face difficulties in obtaining birth certificates, family cards, and citizenship recognition, which limits their access to education, public services, and other civil rights. This study aims to identify the complexity of legal issues arising from siri mixed marriages and to evaluate the effectiveness of legal protection provided in Indonesia and Brunei Darussalam. The research employs a normative juridical method with a comparative legal approach. Data sources are drawn from primary and secondary legal materials through literature review, and analyzed qualitatively. The findings indicate that the absence of legal registration results in a lack of legal protection for children. Indonesia offers solutions through marriage validation (isbat nikah) and civil registration, while Brunei emphasizes administrative legality through the Sharia Court. These differences underline the need for regulatory harmonization and increased public legal awareness. In conclusion, although both countries strive to offer protection, children from unregistered mixed marriages remain legally vulnerable, and legal reforms are needed to ensure that children's rights are upheld without discrimination
