This study in-depth analyzes the phenomenon of the threshold for regional head nominations in Indonesia, which has long been a crucial parameter in determining the success of regional elections but has also raised issues of limited political participation and the potential for strengthening the dominance of large parties. With the aim of investigating the impact of the threshold policy on the democratic process and analyzing the role of the Constitutional Court in judicial review of its constitutionality, this study adopts a normative legal research method supported by legislative, conceptual, and case studies, specifically Constitutional Court Decision Number 60/PUU-XXII/2024. The results show that the Constitutional Court's decision fundamentally changes the nomination mechanism, opening space for political parties without seats in the Regional People's Representative Council (DPRD) to nominate candidates based on valid vote acquisition (6.5%-10%). This change has had a positive impact on increasing public participation, the emergence of alternative candidates, and the potential for improving the quality of regional leadership, although it requires regulatory harmonization and institutional readiness of election organizers. Overall, excessively high thresholds can hinder true democracy, and this Constitutional Court decision is a progressive step that strengthens the values of justice, representation, and inclusivity in regional head elections.
