Abstract

The rampant sale of counterfeit anime merchandise through digital platforms raises serious legal issues that harm consumers and violate intellectual property rights. This research aims to examine consumer legal protection in this context based on a criminal law perspective. The methods used are normative and empirical juridical approaches, by examining laws and regulations and conducting surveys of consumers. The results of the research show that: 1). Although legal protection has been regulated in Law Number 8 Year 1999 on Consumer Protection, the Criminal Code, as well as the Law on Trademark and Copyright, its implementation in the realm of online transactions is still not optimal. 2). Practices in the field still face various serious obstacles, such as the absence of an easily accessible and transparent complaint mechanism. 3). The sale of counterfeit goods consciously and systematically falls into the category of fraud and IPR violations, punishable by criminal sanctions in the form of imprisonment and fines as stipulated in the applicable regulations.
