Abstract

This research examines the principles of legal protection for child perpetrators in cases of sexual violence, with a focus on decision Number 43/Pid.Sus-Anak/2023/PN Mdn. The aim of the research is to determine the application of the principles of legal protection for child offenders and the judge's considerations in imposing a prison sentence of 3 years and 6 months. The research method used is normative legal research with a case approach and statue approach using data from primary and secondary legal materials which are analyzed descriptively and interpretatively. The research results show that the principle of legal protection for child offenders has been implemented using the Juvenile Criminal Justice System Law, but there are shortcomings in its implementation. The judge's consideration in imposing a sentence reflects the principle of the best interests of the child and a restorative justice approach, although it still requires improvement in several aspects. This research highlights the importance of increasing the implementation of legal protection for children who commit crimes, as well as the need for more comprehensive considerations in court decisions to ensure restorative justice and the best interests of children.
