Abstract
This research examines the criminal offense of wages below the provincial minimum wage, using normative juridical research methods that refer to legal norms contained in laws and court decisions. The legal materials used are primary legal materials based on court decisions and secondary legal materials obtained from laws and regulations, books, journals, the internet, and other reading materials. The approach used is the statutory approach and case approach. The data collection method used is the literature study method and the data is compiled quantitatively. Data analysis techniques in the form of syllogism and interpretation methods. The results of this study show how positive criminal law views companies that provide wages below the provincial minimum wage as a criminal offense and sanctions for companies or employers who violate it, which are regulated in Law of the Republic of Indonesia Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law article 185, namely threatened with imprisonment for a minimum of 1 (one) year and a maximum of 4 (four) years and / or a fine of at least Rp. 100,000,000.00 (one hundred million rupiah) and a maximum of Rp. 400,000,000.00 (four hundred million rupiah).
