Abstract

This research examines the dynamics of requests for child marriage dispensation at the Madiun City Religious Court, so that a study is needed regarding problems regarding child marriage dispensation at the Madiun City Religious Court, with legal issues discussed regarding the dynamics of requests for child marriage dispensation at the Madiun City Religious Court from 2021- In 2023, the Madiun City Religious Court Judge's considerations in deciding child marriage dispensation cases and the Madiun City Religious Court's efforts to reduce the number of child marriage dispensations in Madiun City. The method used by the author is a normative-empirical research method, namely research on legal provisions that have been codified, such as statutory regulations, and their application to specific legal events in society using primary data and secondary data. The data analysis technique used is interactive data analysis from Rules & Huberman. The first research result is that the dynamics of applications for child marriage dispensation at the Madiun City Religious Court in 2021-2023 are increasing every year, but the numbers are not large. The results of the second research are the basic considerations of Madiun City Religious Court judges in deciding child marriage dispensation cases, namely by referring to Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Adjudicating Marriage Dispensations, the Marriage Law, and the Compilation of Islamic Law. The third research result is the efforts of the Madiun City Religious Court to reduce the number of child marriage dispensations in Madiun City by carrying out preventive and curative efforts.
